BoyarMiller Secures Jury Win for Environmental Earth-Wise, Inc.

HOUSTON, TX (January 19, 2025) – BoyarMiller successfully obtained a favorable jury verdict on behalf of Environmental Earth-Wise, Inc. (EEW) on January 17. After a four-day trial, the jury awarded EEW $300,000 in actual damages and $200,000 in attorneys’ fees and expenses.

The trial team included Lee A. Collins, Alexandra Wolf, and Antrice Thomas. The verdict, delivered in the 239th District Court of Brazoria County, follows two years of litigation and affirmed the value and necessity of the services provided by EEW. The jury’s decision reinforced that the work performed was beneficial and valuable to the defendant and warranted compensation.

The case, Cause No. 121685-CV; Environmental Earth-Wise, Inc. v. Audubon C. Stores, Inc. d/b/a Minute Mart, involved a dispute over payment for an emergency environmental response that included spill assessment and remediation services performed by EEW on underground petroleum storage tanks located on the defendant’s property in Freeport, Texas. The defendant unsuccessfully challenged the reasonableness and necessity of the charges for the services provided.
